Electronic Delivery Disclosure Notice

PLEASE READ THIS NOTICE CAREFULLY. PRINT OR SAVE A COPY FOR YOUR RECORDS.


Scope of Consent

You have the option to conduct business with the Company (meaning the Fortegra Group and all of its affiliate insurance, roadside assistance and extended service contract companies) electronically.  If you decide to conduct business with the Company electronically, you may consent to the use of your electronic signature and to the electronic delivery of notices, consumer disclosures, documents and information, as well as claims and other interactions with the Company (the “Documents”) related to your insurance, roadside assistance and/or extended service contract products. Your consent will only apply for the specific transaction for which you gave consent to the Company. Before you sign an application for one of our products, the Company or its representative is required to provide you this document entitled “Electronic Delivery Disclosure Notice.”

If you decide to complete an electronic insurance application from the Company, you will be asked to provide an electronic signature (which will be applied to your application forms) and to give consent to receiving the Documents electronically at the end of the process.  Your electronic signature will be as legally binding and enforceable as if you had signed on paper with a pen.

If you consent to electronic delivery of the Documents but decline the electronic signature process, the Company cannot continue processing your application electronically.  You can still apply on our paper application, but it could take longer to process your application.

If you want a paper copy of the Documents but still want the Company to process your application electronically, we will still need your consent to receive the Documents electronically.  You may also request a paper copy of the Documents at any time.  You will not be charged for paper copies of any of the Documents you request.

 

Accessing Your Communications

We may deliver your Documents by any of the following means: (1) within the Company’s website, (2) to your designated email address, (3) via our mobile application(s), or (4) by requesting that you download a PDF file that contains the Documents.

 

Hardware and Software Requirements

To access and retain electronic Documents, you must have an active email address and an up-to-date computing or mobile device with:

  • A connection to the Internet;
  • A Current Version (defined below) of a web browser (such as Internet Explorer, Chrome, Safari or Firefox);
  • A Current Version of a program that accurately reads and displays PDF files; and
  • Electronic storage to retain records and/or a printer to print them.

By “Current Version,” we mean a version of the software that is currently being supported by its publisher.  If you do not have a PDF reader, you can download Adobe® Reader® at no charge from the following link: https://get.adobe.com/reader/  (By clicking the link, you will be taken to a third-party site not managed by Capital One, where different security or privacy practices may apply.)

If you do not have the required software and/or hardware, or if you do not wish to use electronic signatures or consent to receiving the Documents electronically for any other reason, you can ask your representative to complete a paper application and to provide you the Documents in paper form instead at no cost to you.

 

How to Withdraw Your Consent

You may withdraw your consent to receive electronic communications from the Company at any time.  Your withdrawal of consent is effective only after the Company has had a reasonable period of time to act upon your withdrawal.  Withdrawal of consent to electronic delivery will not affect the legal effectiveness, validity, or enforceability of Communications previously provided electronically.

 

Your Contact Information

If you fail to update or change an incorrect email address or other contact information, you understand and agree that any electronic Communications shall nevertheless be deemed to have been provided to you if they were made available to you by one of the methods described above.

 

How to Contact the Company

If you wish to take any of the actions, or to update your contact information, you may do so by writing to the Company at 10751 Deerwood Park Blvd., Ste. 200, Jacksonville, FL 32256, by using a method that may be available to you on the Company’s website, or by calling the Company at 800-888-2738.  We ask that you include your name, address, and date of birth in any written correspondence to the Company. 

 

Termination and Changes

We reserve the right to discontinue providing you with electronic Documents, or to terminate or change this eCommunications disclosure.  We will provide you with notice of any such termination or change as required by law.

 

Consent

By consenting, you agree:

  • To use electronic signatures and records during the Company’s relationship with you;
  • To receive the Documents electronically; and

·  That you have access to equipment through which you can access the Documents and which you can use to retain the Documents.
